PRIVACY POLICY
The following terms and conditions govern the contractual relationship between FROM LIGHTING S.r.l. and consumers or professionals who purchase products through our online store. The commercial terms and conditions of the customer, contrary to or different from ours, are not accepted. The language of the contract is Italian. These terms and conditions apply to orders placed either by telephone or online. If you purchase our products through one of our business partners, only their specific terms and conditions will apply.
2 Conclusion of contract
2.1. Online offers are a non-binding offer to you to purchase goods.
2.2. After you have entered your details, by clicking on the order button you make a binding offer to conclude a sales contract. You can also place an order by telephone, which is also binding.
The order confirmation and details of the order and the contract (i.e. model purchased, color, size, price, etc. …) are sent to the customer by e-mail, but are not available within the website. The terms and conditions of the contract are also sent by e-mail and remain available at any time within the website.
During the ordering process it is possible at any time for the customer to modify and correct the information and data entered by restarting the process using the “Delete” button before placing the order. During the ordering process the customer will be informed of any other option for correction/modification of the information and data entered. It is possible for the customer to terminate the ordering process at any time by closing the browser.
All prices previously in force lose their validity against the current quotation on e-commerce. We reserve the right to make interim price adjustments. We do not accept any liability for errors.Our prices include the sales taxes currently valid for deliveries within the Republic of Italy. We also charge the Italian sales tax for orders within the European Union in accordance with the law, unless you provide us with your valid VAT identification number (or VAT ID) for VIES purposes with your order.

7 Payment
For the payment of the price of the products and the related shipping and delivery costs you can follow one of the methods indicated in the order proposal form.

8 Reservation of Proprietary Right
The delivered goods remain our property until full payment has been received as stated in art. 1523 of Italian Civil Code.
9 Shipping Costs
For purchases made within the online shop of FROM LIGHTING S.r.l. no shipping costs are applied.
For purchases made directly to FROM LIGHTING S.r.l. by a VAT owner, shipping and insurance costs will be borne by the buyer, unless otherwise agreed by the parties on an individual basis.
Deliveries may not be made to P.O. boxes or parcel depots or collection stations. For customized orders we reserve the right to manage the order through multiple partial deliveries. The delivery is made to the address indicated in the order and delivered personally against the affixing of a signature. The customer who placed the order accepts that the delivery can be delivered to another person implicitly authorized to accept the package. This includes in particular family members or employees present at the address of the recipient, as well as immediate neighbours. If the delivery is made to a neighbour, the recipient receives a notification form. If the shipment cannot be delivered in the manner specified above, a maximum of three further delivery attempts are made for domestic deliveries and up to two further delivery attempts for international deliveries. We will inform you if an ordered item cannot be shipped in a timely manner.
11 Guarantee
The products are guaranteed by law against manufacturing defects and are CE certified. If the delivered items show obvious transport damage, please ask the courier for certified confirmation. This point is very important for our insurance conditions. Please check for minor damage, write it down on the shipping documents and notify us without delay. The prompt reporting of an error or damage will simplify any warranty intervention. Goods are transported at the risk of the consignee, unless the consignee is the customer himself. We do not guarantee that the delivery dates will be adhered to.
12 Right of withdrawal in accordance with the provisions of the Consumer Code – Legislative Decree no. 206/2005
The right of withdrawal applies only to consumers as defined in Art. 3 of Legislative Decree no. 206/2005. A consumer is a natural person acting in a commercial transaction for purposes unrelated to the business, commercial, craft or professional activity that may be carried out. The right of withdrawal does not apply to products that are not part of our range of products, but were ordered for you at your request.
13 Instructions for withdrawal in accordance with art. 54 D. Legislative Decree no. 206/2005
You can withdraw from your contract without specifying the reasons (so-called withdrawal ad nutum) within 14 days of receipt of the goods by simple written notice (for example, by registered mail or e-mail) or simply by returning the goods. The deadline for exercising the right of withdrawal is 14 days from the day on which the consumer or another person, other than the carrier and designated by the consumer, acquires physical possession of the goods. Timely notification of the exercise of the right of withdrawal or return of the goods is sufficient to interrupt the time-limit. The notice of revocation should be sent to:

14 Consequences of withdrawal
We will refund all payments received, including standard delivery charges, within 14 days from the day we are informed of the withdrawal. However, the customer is responsible for any decrease in the value of the goods resulting from the handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods.
Free return is only possible on condition that the goods are returned in the anti-breakage carton packaging in which they were originally delivered, because only this packaging ensures that the goods are not damaged during normal postal or courier transport. After the item has been successfully returned we will promptly refund the purchase price by crediting the customer’s account or by bank transfer to a bank account of your choice. The shipping costs for the return are borne by the customer.
15 Miscellaneous
15.1. Changes to catalogues
We reserve the right to make slight changes to the illustrations in the catalogue.
15.2. Liability
Apart from the rights guaranteed by consumer protection laws for distance selling, FROM LIGHTING’s liability as a manufacturer is limited to damages caused by a serious breach of contract by FROM LIGHTING or by an intentional or grossly negligent breach by one of FROM LIGHTING’s legal representatives or vicarious agents as long as the damages do not result in personal injury. The data, suggestions and information we provide have been collected with the utmost care and are regularly updated. Nevertheless, we do not assume any responsibility for the completeness, correctness and timeliness of updating any of the information provided. We accept no liability for technical errors or inaccuracies. The delivery times indicated are not guaranteed but are only estimated times and are beyond our control. We do not assume any liability for any damage resulting from delivery difficulties.
15.3. Delayed payment for a delivery
If the agreed payment terms are exceeded, the legal provisions on late payments in commercial transactions shall apply. If the buyer fails to meet the maximum payment period, all debts arising from the business relationship shall become due immediately without the need for any notice of default.
15.4. Jurisdiction and applicable law
For any dispute relating to the interpretation or execution of this contract, the court of Padua (Italy) shall have exclusive jurisdiction and Italian law shall apply, except in cases where the law expressly provides for the mandatory nature of the competence and the application of the law by territory.
15.5 Notice on data protection
We collect your data only for the purposes of your order and its processing.
We do not share your data with third parties, with the exception of partners necessary to process your order.
Customer data is stored and processed in accordance with the relevant provisions of the Italian Data Protection Act and EU Regulation 2016/679 (GDPR).
